3D VSP values the right to privacy and is committed to ensure all personal data is obtained, processed and used in a safe, secure, ethical and transparent way. We hereby inform you about the processing of your personal data by us and the rights to which you are entitled in accordance with the data protection regulations. By providing us with your information, you confirm that you have acknowledged the content of this Privacy Policy, which is meant to help you understand what personal data we collect about you, why we collect it, and what we do with it. Which data is processed and used in which way in detail depends decisively on the services requested by you or agreed with you.

2. What sources and data do we use?

As a general rule, 3D VSP B.V. will only collect your personal data where necessary for maintaining our relationship with you as business contact and as a (potential) customer. We process personal data which we receive from you within the scope of our business relationship. In addition, we process – insofar as necessary for the provision of our services – personal data which we have received from third parties in a permissible way (e.g. for the execution of orders, for the fulfilment of contracts or on the basis of your consent).

3. For what purpose do we process your data (purpose of processing) and on what legal basis?

We process personal data in accordance with the provisions of the European General Data Protection Regulation (GDPR):

  1. Necessity for the performance of a contract with you (Art 6 para. 1 lit. b GDPR)); or
  2. Legal requirements to which 3D VSP B.V. is subject (Art. 6 para. 1 lit. c GDPR); or
  3. Based on public interest (Art. 6 para. 1 lit. e GDPR); or
  4. Legitimate interests of 3D VSP B.V. (Art. 6 para. 1 lit. f GDPR); or
  5. Your explicit and informed consent (Art. 6 para. 1 lit. a GDPR)
4. Who gets my data?

Within 3D VSP B.V. those bodies that need your data to fulfil our contractual and legal obligations will receive it. Processors used by us may also receive data for these purposes. In any case, 3D VSP B.V. shall restrict the access and transfer of your personal data to trusted third-party recipients only. Data will only be passed on to recipients outside 3D VSP B.V. if this is required by law, you have given your consent or we are authorised to provide this information. Under these circumstances, recipients of personal data may be, for example, public authorities and institutions (e.g. supervisory authorities) if there is a legal or official obligation.

5. Will data be transferred to a third country or to an international organization?

3D VSP B.V. is headquartered in the Netherlands. Data will not be transferred to third countries (counties outside the European Economic Area – EEA). Insofar as your personal data needs to be transferred to a country outside of the EEA, which does not offer adequate protection of personal data, 3D VSP B.V. will put in place appropriate safeguards offering a level of protection at least equivalent to the standards contained in this Privacy Policy.

6. How long will data be stored?

As a general rule, 3D VSP B.V. only keeps your personal data for as long as necessary to fulfill the purposes for which we initially collected it. However, based on the type of personal data being processed and the processing purposes, the actual retention periods may vary significantly. In addition, there are laws and sectoral regulations that apply, and which set minimum periods for retention of personal data. Collected data of website visitors (keyword: logfiles) will be deleted at regular intervals. Processed user data of members of the restricted user area of the website are stored longer in order to be able to guarantee subsequent access by the users.

7. What data protection rights do I have?

Although 3D VSP is technically the Data Controller, the ultimate control over your personal data remains with you at all times, on condition that you provide us a proof of your real identity.

Every data subject has the right of access according to Art. 15 GDRP, the right to rectification according to Art. 16 GDPR, the right to erasure according to Art. 17 GDPR, the right to restriction of processing according to Art. 18 GDPR as well as the right to data portability according to Art. 20 GDPR. The restrictions according to §§ 34 and 35 BDSG apply to the right to information and the right to cancellation. In addition, there is a right of appeal to a data protection supervisory authority (Art. 77 GDPR in conjunction with § 19 BDSG).

Information about your right to object according to Art. 21 GDPR
You have the right to object, on grounds relating to your particular situation, at any time to processing of personal data concerning you which is based on Art. 6 para. 1 lit. f GDPR (data processing on the basis of legitimate interests). This includes profiling based on those provisions. In case that you object, we shall no longer process the personal data unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms or for the establishment, exercise or defence of legal claims.

8. Is there an obligation for me to provide data?

As part of our business relationship, you must only provide personal data that is required for the establishment, performance, and termination of a business relationship or which we are legally obliged to collect. Without this data we will normally have to refuse the conclusion of the contract or the execution of an order or will no longer be able to execute an existing contract and may have to terminate it. Furthermore, it is necessary for us to request additional data on how to process your desired payment method in order to provide chargeable services.
